Defense Verdict Obtained on Behalf of Suffolk Neurosurgeon

Doug Morgan and Rebecca Capozzi obtain defense verdict on behalf of Neurosurgeon in Suffolk Superior Court

MBB+M Shareholders Doug Morgan and Rebecca Capozzi obtained a defense verdict on behalf of their client, a Neurosurgeon, in a two-and-a-half-week trial Suffolk Superior Court. Plaintiff alleged that our client’s performance of a stereotactic endoscopic fenestration of the medial portion of a left occipital arachnoid cyst with a placement of an external ventricular drain in the left occipital horn was performed negligently causing hemorrhage and brain injury with resulting deep right hemiparesis and no speech output. Plaintiff was left with both substantial cognitive and motor deficits. The defense made extensive use of the intraoperative video that was performed during the surgery and the pre- and post-operative imaging studies to demonstrate that the procedure was performed appropriately but that, unfortunately, a recognized complication occurred resulting in the outcome. The jury returned a defense verdict for our client on standard of care.
