Doug Morgan and Rebecca Capozzi obtain defense verdict on behalf of OB/GYN in Plymouth Superior Court (Plymouth)

MBB+M Shareholders Doug Morgan and Rebecca Capozzi obtained a defense verdict on behalf of their client, an OB/GYN, in a two-and-a-half-week trial Plymouth Superior Court (Plymouth). Plaintiff alleged that during her labor and delivery, there was a failure to appreciate a deteriorating fetal heart strip and adequately carry out a timely caesarean section causing hypoxic brain injury to her daughter along with substantial cognitive and motor deficits. The defense centered on our client’s careful monitoring of the strips, and preparation of the OR for surgical readiness, but also emphasized the substantial habitus of the plaintiff and our client’s difficulty in determining appropriate anatomical landmarks, despite her best judgment, during the caesarean section, as well as her heroic efforts in dislodging plaintiff’s baby and getting her rapid NICU support. The jury returned a defense verdict on behalf of our client on standard of care.
