Jim Barry obtains defense verdict on behalf of vascular surgeon
MBB+M Shareholder, Jim Barry, recently obtained a defense verdict on behalf of his client, a vascular surgeon, after a six-day trial in Bristol Superior Court (Taunton). The plaintiff had alleged a failure to emergently intervene surgically to treat his ischemic limb, as well as a delay in post-operative care, which resulted in permanent neurologic injury to the plaintiff’s leg, including a foot drop. Attorney Barry argued that his client’s treatment of the plaintiff, including his decision to defer surgical intervention until appropriate work-up and evaluation could take place, was appropriate and consistent with the standard of care. After deliberation, the jury returned a verdict of no negligence on the part of the vascular surgeon.
