Shareholder Amy Galatis recently prevailed on a Motion to Dismiss for her client; a community hospital located in Middlesex County. The plaintiff alleged that a physician working at the hospital issued a prescription without a valid Massachusetts physician’s license, allegedly causing it to later be rejected by the pharmacy. A Superior Court judge allowed the motion based on plaintiff’s counsel refusing to comply with a court order to provide an Offer of Proof and comply with related statutes and orders.
